Commercial High Court issues notice on Harry J.

The Business partners of D.H.S. Jayawardana, who first formed “Stassen Exports Ltd” with him, filed a case before the Commercial High Court of Western Province, to give up there connection to him.

They alleged that D.H.S. Jayawardana changed his attitude towards them, when he was appointed to various positions in Government and State corporations, as senior advisor to the President, Board of Investment and SriLankan Airlines.

R.K. Obeysekera, Zaki Alif and V.P. Vitachi, Petitioners in this case, further alleged that Jayawardana began to pursue an aggressive Business strategy, often testing the limits of legality, which created discomfort and concern to the Petitioners.

Commercial High Court Judge of the Western Province, Rohini Walagama, after hearing the submissions made by Petitioners’ Counsel, issued notice on Respondents, Milford Exports (Ceylon) Ltd, D.H.S. Jayawardena, Mrs. Company Secretary, Secretaries and Registrars (Pvt) Ltd., Sonia Weinman, returnable on August 29, 2008.

Court also ordered Respondents to show cause why relief should not granted to Petitioners, as prayed in their petition.

Romesh de Silva P.C. with Sugath Caldera, instructed by G.G. Arulpragasam, appeared for Petitioners.

Counsel requested court to direct Jayawardena to purchase their shares or shell his shares to Petitioners and to issue an Interim order preventing first Respondent company or Jayawardena from taking any steps whatsoever, to alter the present status quo of the Board of Directors of the Company.
